That’s just silly theatrics. If a governor were
individually and directly harbouring an illegal alien, that would absolutely meet the elements of the offence enumerated under Title 8 U.S. Code, section 1324. It would not, however, subject them to criminal liability for being in a political leadership role in states that have legislation or regulation wherein they won’t provide any assistance at state level to certain immigration enforcement.
If Mr. Homan wants to threaten governors with Offences pertaining to illegal aliens, he should be live to the fact that that same section, in subsection (a)(1)(A)(ii), establishes as an offence, “knowing or in reckless disregard of the fact that an
alien has come to, entered, or remains in the
United States in violation of law, transports, or moves or attempts to transport or move such alien
within the
United States by means of transportation or otherwise, in furtherance of such violation of law”. A subsequent section includes any conspiracy to that end. This hearkens back to at least one Governor who was compelling illegal migrants to get on planes and/or buses and sending them up to other states.
