From what I understand this lawsuit is mostly to do with interest and punitive damages as VAC has paid most of the class back already. For most these are very small amounts.
I can't speak for the mental health aspect there are people who have DEC due to mental health though. If you have another condition put it in right away as it will only stand to support you in other benefits including a DEC decision.

You might be entitled if you were recieving a monthly allowance at time of release. SISIP has 2 years to payout they are suppose to pay 50% of the class within the first year. As of right now nobody has been paid.

Yes, it does state that VAC will claw back monthly payment increases. They will not claw back the lump sum or any monthly amount received up until they make the claw back calculation.
